Court Sanctions Six Qualcomm Attorneys


San Diego, CA (AHN) - A federal judge Monday said six Qualcomm attorneys should be investigated by the California State Bar Association for possible ethics infractions. The action followed the revelation Qualcomm withheld thousands of documents during a patent-infringement lawsuit against rival Broadcom.

"Qualcomm intentionally withheld tens of thousands of decisive documents from its opponent in an effort to win this case and gain a strategic business advantage over Broadcom," U.S. Magistrate Judge Barbara Major ruled. In October, Major demanded 19 Qualcomm lawyers explain why the documents were not turned over to Broadcom.

After Qualcomm sued Broadcom in 2005, charging its rival infringed two video-compression patents, a federal court recently ruled Qualcomm must pay $8.5 million in damages.
During the lawsuit, a Qualcomm worker said the San Diego company didn't turn e-mails over to Broadcom and after the trail ended, more Qualcomm documents were found not to have been provided. Partly as a result, Qualcomm's general counsel quit.
